Who these terms are between

This website, 123gameslux.com, is an advertising domain operated by Globway International B.V., Spoorhaven 44-46, 2651 AV Berkel en Rodenrijs, Netherlands, registration number 66882915.

The subscription itself is concluded on the signup page of your mobile operator. These terms govern the service advertised here and the relationship between you and Globway International B.V. Your operator’s own conditions apply to the billing relationship you have with them.

By subscribing you confirm that you are at least 18 years old and that you are the account holder for the mobile number, or have the account holder’s permission.

What the service is

123 Games is a subscription to a catalogue of browser games, currently 552 titles across 10 categories. The games run in an ordinary web browser; nothing is installed on your device.

The catalogue changes over time. Titles are added, and now and then a title is withdrawn because its licence ends. The subscription is to the catalogue as a whole rather than to any single title, so the loss of one game is not a reduction of the service.

Access needs an internet connection and a reasonably current browser. We do not promise that every title works on every device or on every browser version ever released.

Price and billing

The price is €9.00 per week, charged by your mobile operator on your invoice or against your prepaid balance.

Your own plan’s charges for SMS, WAP, GPRS and mobile data apply on top, exactly as they do for any other use of your phone. Those rates are set by your operator, not by us.

All prices are in euro and include VAT where it applies.

Term, renewal and stopping

The subscription starts when you confirm it by SMS and runs for one week. It renews automatically for further weekly periods until it is stopped.

You can stop at any time, with no notice period and no fee. Send STOP to 67825 by SMS, or email contact@123gameslux.com from the mobile number the subscription runs on.

Stopping takes effect at the end of the week already paid for. Access stays open until then, after which nothing further is charged. Weeks already started are not refunded pro rata.

We may suspend or end a subscription that is used fraudulently, where charges are repeatedly reversed, or where the operator relationship carrying the billing ends.

Your right of withdrawal

As a consumer in the European Union you normally have fourteen days to withdraw from a distance contract without giving a reason.

This service is digital content supplied immediately. When you confirm the subscription you ask for that immediate access and acknowledge that you lose the right of withdrawal once delivery has begun. That is the standard position under the Consumer Rights Directive and it is why we make the point here rather than burying it.

It matters less than it sounds: you can stop the subscription on the day you start it, and you will then have paid for one week and nothing more.

If you would rather withdraw before playing anything, email contact@123gameslux.com within fourteen days and we will sort it out.

Your rights as a consumer

Nothing in these terms limits the rights you have under mandatory consumer law in Luxembourg or under the rules your mobile operator applies to premium services. Where a clause here conflicts with such a right, the right wins.

Intellectual property

Game titles, cover art, characters and trademarks belong to their respective rights holders. The subscription gives you a personal, non-transferable right to play the games through the service for as long as it is active.

It does not give you the right to download, copy, reverse engineer, redistribute or publicly perform any title, or to use the games commercially.

Acceptable use

The subscription is for personal use by one person. Sharing access, automating play, interfering with the service or reaching for parts of it you have not subscribed to are all grounds for ending it.

Liability

The service is provided as it stands. We take reasonable care to keep it available, but we do not promise uninterrupted access: maintenance happens, networks fail and browsers change.

To the extent the law permits, liability is limited to the amount you paid for the subscription in the three months before the event complained of. Liability for death or personal injury, for intent and for gross negligence is not excluded, because it cannot be.

Changes to these terms

We may amend these terms, for example when the offer, the operators or the law change. The version published on this page is the one that applies, with the date of the last update at the top.

If a change materially disadvantages you, you are free to stop before it takes effect, on the same terms as any other stop.

Privacy

Personal data is handled as set out in our privacy policy, which explains what this website collects, what your mobile operator handles instead, and what rights you have.

Governing law and disputes

These terms are governed by the law of the Netherlands, where Globway International B.V. is established. As a consumer resident in Luxembourg you keep the protection of the mandatory provisions that would apply to you in any case, and you may bring proceedings before the courts of your own place of residence.
